1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the BetterClaim website, web app, and related services (collectively, the "Service") operated by BetterClaim, Inc. ("Better Claim," "we," "us," or "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Who We Are (Education Only — Not a Public Adjuster or Law Firm)

BetterClaim provides educational information and organizational tools to help homeowners better understand property insurance claim documents and typical claim processes.

BetterClaim is not:

• A public insurance adjuster
• A law firm or provider of legal advice
• An insurance company, insurance agent, or broker

We do not:

• Represent you in a claim
• Negotiate with or contact insurers on your behalf
• Decide what your claim "should" be worth
• Guarantee any coverage, payment, or outcome

You are solely responsible for decisions you make regarding your claim, including whether to accept or reject any offer, hire any professional, or communicate with your insurer.

3. Eligibility & Accounts

You must be at least 18 years old to use the Service. You agree to provide accurate information and keep your account credentials secure. You are responsible for activity under your account.

4. The Service

The Service may allow you to:

• Upload or enter claim-related information (estimates, letters, photos, policy pages, etc.)
• Receive AI-assisted educational summaries, checklists, and suggested next steps
• Generate sample templates (e.g., questions to ask or example emails)
• Track "Smart Tasks" and document status
• Request introductions to independent contractors (optional)

We may change or discontinue any part of the Service at any time.

5. No Professional Advice; No Guarantees

Any outputs (summaries, checklists, scenario ranges, templates, or "gap" indicators) are informational and educational only. They may be incomplete, outdated, or incorrect.

You understand and agree:

• We do not provide legal advice or act as a public adjuster
• We do not guarantee that any missing items exist in your claim
• We do not guarantee the accuracy of any scenario cost ranges or comparisons
• Insurance outcomes depend on policy terms, evidence, the insurer, and other factors outside our control

If you need professional advice, consult a licensed public adjuster, attorney, or other qualified professional in your state.

6. Vendor Introductions / Marketplace (If Offered)

If we provide vendor lists or "share my case for quotes" features:

• Vendors are independent third parties
• You choose whether and with whom to share your information
• BetterClaim does not control vendor pricing, availability, performance, or outcomes
• BetterClaim does not guarantee quotes, response times, or quality of work
• BetterClaim does not endorse any vendor unless explicitly stated

Any vendor relationship is between you and the vendor. You should independently verify licenses, insurance, references, and suitability.

7. User Content & Permissions

"User Content" includes documents, images, text, and information you upload or submit.

You retain ownership of your User Content. By submitting User Content, you grant BetterClaim a non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, and process your User Content to:

• Provide the Service
• Improve product performance and user experience
• Maintain security, prevent fraud, and enforce these Terms
• Comply with legal obligations

How we collect and use personal information is described in our Privacy Policy.

8. Prohibited Use

You agree not to:

• Use the Service for unlawful purposes
• Provide false, misleading, or fraudulent information
• Attempt to access accounts or data not belonging to you
• Reverse engineer, scrape, or disrupt the Service
• Use outputs from the Service to impersonate a licensed professional or misrepresent facts to insurers or others

We may suspend or terminate access for misuse or suspected abuse.

9. Fees, Trials, and Payments (If Applicable)

Some features may be free or paid. If you purchase paid features:

• Prices and billing terms will be shown at checkout
• You authorize our payment processor to charge your payment method
• Refunds (if any) are governed by the policy shown at purchase

10. Intellectual Property

The Service (excluding your User Content), including text, design, and software, is owned by BetterClaim or its licensors and protected by intellectual property laws. You may not copy, distribute, or create derivative works from the Service without permission.

11. Third-Party Services

The Service may link to or integrate with third-party services. We are not responsible for third-party content, policies, or practices.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access at any time for violation of these Terms, suspected fraud, or to protect the Service and users.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be accurate, uninterrupted, secure, or error-free.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERCLAIM WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

• THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR
• $100

Some jurisdictions do not allow certain limitations; in that case, those limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless BetterClaim and its affiliates from any claims arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

16. Governing Law; Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute will be brought in state or federal courts located in Orange County / Los Angeles County, California, unless required otherwise by law.

17. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective means you accept the updated Terms.
